Dallas City Ordinance No. 26369
Official Action of the Dallas City Council:
An ordinance amending Article 269, “PD 269,” of Chapter 51P, “Dallas Development Code: Planned Development District Regulations,” of the Dallas City Code, as amended; amending Article 269 by adding standards for measuring of distances between nonconforming uses; adding definitions for body piercing studio, commercial parking garage, commercial parking lot, dace hall, live music venue, and tattoo studio; requiring an SUP for bars and private clubs; requiring an SUP and 300 foot spacing between body piercing studios and tattoo studios; requiring an SUP for dance halls and live music venues; providing that body piercing studios, tattoo studios, dance halls, and live music venues cannot be accessory uses; deleting references to Class D dance halls; eliminating the parking requirement for single-family and duplex uses; reducing the parking requirement for multifamily uses; exempting the first 2,500 square feet of floor area of office, retail, bar, and restaurant uses from parking requirements; prohibiting the use of delta credits for the parking requirement for bars and dance halls; requiring parking for dance halls; eliminating the parking requirement for library, art gallery, museum, and handcrafted art work studio uses; reducing the parking requirement for use in proximity to DART stations; allowing on-street parking to count toward parking requirements; allowing uses to charge for required parking; setting an amortization date for nonconforming bars, tattoo studios, body piercing studios, and dance halls; counting materials used on the front facade (not side and rear0 toward design points; allowing design points for concrete masonry; giving design standard points for sidewalk cafes; granting a private license for landscaping, awnings, arcades, and sidewalk cafes; deleting an appeal process (defaulting to normal appeal process); deleting a provision for a tax freeze for historic properties (defaulting to Art. XI); adding site plan, construction, stripping, lighting, trash receptacle, attendant booth, access opening, fencing, landscaping, and other requirements for commercial parking garages and commercial lots; deleting a prohibition on assessments; and deleting a requirement for staff evaluation of the PD; waving the fee for SUP’s for nonconforming uses for one year; providing a penalty not to exceed $2,000; providing a saving clause; providing a severability clause; and providing an effective date.
